Abstract:
Carriage of goods by sea shall be studied in two categories: contract under the bill of lading and charter party. Article 55 of Iranian maritime code, following Brussels’ convention; provides exemptions from liability of carrier in contract under the bill of lading and, just gives examples of force majeure without clear referral to it. As the rules are mandatory and it is impossible to insert a restricting clause or increase liability, in this thesis writer tries to suggest a solution for possibility of referring to force majeure in the mentioned contracts.
Effect of force majeure in domain of charter parties has no trait to study. But the present thesis is to analyse the effect of force majeure in a situation that some contractual obligations have been carried out and force majeure is the impediment to execution of contract.
